Please carefully review these terms before placing an order on alanholloway.co.uk. By submitting an order on this website, you agree to the following terms and conditions. To register with and shop at alanholloway.co.uk, you must be eighteen years of age or older.

1. Purchase Contract

1.1 This website is operated by Alan Holloway Patissier & Chocolatier (referred to as "Alan," "I," "him," "we," "he," "us," or "our"). All purchases made on this website are subject to these Terms and Conditions.

1.2 Alan sells goods exclusively to end-user consumers and conditions them not to be resold or circulated without Alan's prior written consent.

1.3 Alan will confirm your order's acceptance, either through a website message immediately after order confirmation or via an email sent to the address provided by you. Alan may employ both methods. At this stage, the purchase contract will be formed, and Alan will deliver the goods as per your order and these Terms and Conditions.

1.4 To use Alan's service, you must be 18 years of age or older and have completed the registration process.

 

2. Price and Delivery Charges

2.1 The goods' prices are as quoted on the website when you confirm your order (typically by clicking the "Checkout" button). If you amend your order later, the prices applied will be those relevant to the amended items at the time of confirmation.

2.2 Website prices include applicable taxes.

2.3 The goods' prices do not include delivery charges. These charges are additional and as follows: A standard delivery charge of £4.89 applies to standard first-class delivery (1-3 working days). The delivery charge is automatically calculated and displayed on the website during the order placement. Please allow extra time for deliveries.

2.4 Next-day delivery is guaranteed only for orders placed before 4 pm on Thursdays, with delivery scheduled before 12 pm on Fridays within the UK mainland. Orders placed after this time will be delivered on the next available delivery day.

 

3. Payment Methods

3.1 Payment can be made by debit, credit, or charge card, or through your PayPal account. Cash or check payments are not accepted for online orders. There is no minimum order requirement.

3.2 Accepted debit, credit, and charge cards are those listed on the website when you place your order.

3.3 Payment authorization will be sought from your card issuer at the time of order placement. Alan reserves the right to terminate the agreement if payment authorization is declined at any stage.

3.4 In the event of a failed payment, you agree to fully indemnify Alan for all costs, expenses, and outgoings incurred in collecting payments from you. This includes an administration charge of not less than £20. Alan may, after a failed payment, engage a debt collection agency to recover the payment from you.

 

4. Delivery

4.1 Delivery will be made to the address specified during registration on the website. Alan retains the right to restrict deliveries in certain areas, including eliminating certain areas from the delivery schedule.

4.2 Product availability is subject to change. While the website is updated daily, if any goods you order become unavailable, Alan may offer a reasonable substitute.

4.3 Alan strives to provide the quantity you've ordered. If the delivered goods are incomplete or incorrect, please notify him promptly. If you're dissatisfied with the quantity received, Alan will arrange for the return of these goods (they must not be used and must be in good condition). You won't be charged for incorrect or undelivered goods. In any case, Alan's liability will be limited to the price of undelivered or incorrectly delivered goods and the delivery cost.

4.4 Alan takes care to ensure deliveries occur within a short time window. However, it is your responsibility to provide accurate delivery address details. Alan does not verify the addresses and messages provided by you. Alan bears no liability, financial, administrative, or otherwise, if you do not receive your order due to incorrect delivery address details. You must ensure someone is available at the delivery address all day. If no one is present during the delivery attempt, standard first-class mail items will be left at a courier-recommended safe location. Please note that adverse weather or events beyond Alan's control may result in occasional delayed or cancelled deliveries. In such cases, Alan will try to contact you to reschedule the delivery. In any event, Alan's liability is limited to undelivered goods' price and delivery cost.

4.5 Failure to be present for delivery entitles Alan to charge you for the full cost of perishable items in your order and the delivery cost.

 

5. Ingredients

5.1 Due to processes within Alan's kitchen, all products may contain trace amounts of NUTS, PEANUTS, EGGS, GLUTEN, MILK, SOY & SESAME.

5.2 Fresh ingredients are used for gourmet chocolate production. Transportation by air is not recommended due to temperature variations caused by altitude changes.

 

6. ​Defective Goods

​

6.1 Alan guarantees the quality of his products. If you are dissatisfied with your order, inspect the products and notify him promptly. Alan will fully refund the cost of any products if any of the following criteria apply to the delivered product(s):

• The products do not match your order.

• The products are damaged or defective.

• The delivery includes an incorrect quantity.

• You do not receive the ordered products (except due to incorrect delivery address details as per clause 4.4). Alan will coordinate the return of products with you and reserves the right to issue refunds as he deems appropriate.

 

​7. Amendment of Orders and Cancellation Rights

​

7.1 Orders can be cancelled if the product has not yet been dispatched. Alan will notify you via email when your goods are dispatched, after which cancellation is not accepted.

 

8. Warranty and Liability

​

8.1 These Terms and Conditions do not limit Alan's liability for death or personal injury resulting from his negligence, nor do they affect your statutory rights.

8.2 In addition to paragraph 4.4, Alan is not in breach of contract or these Terms and Conditions if a delay or failure to perform obligations results from causes or circumstances beyond his reasonable control, such as fire, flood, acts of God, strikes, riots, accidents, energy supply disruptions, civil commotion, acts of terrorism, or war.

8.3 Except as set out in clause 7.1, Alan's maximum liability arising from an order for goods will be limited to the retail price of the goods and the associated delivery cost.

 

9. Customer Complaints

9.1 Alan is committed to providing excellent service. If you are not entirely satisfied with the products you have received, please contact him with your comments. Send any comments or customer complaints to Alan via the email address listed on the "Contact" page of the website.

 

10. Notices

10.1 Unless otherwise specified in these Terms and Conditions, all communications from you to Alan must be in writing and sent via email to the address listed on the "Contact" page of the website. All communications from Alan to you will be displayed on his website from time to time.

 

11. General

11.1. In the event that any of these Terms and Conditions is deemed unlawful, invalid, or unenforceable, whether in part or in full, by any competent court of authority, such a determination shall not impact the validity and enforceability of the remaining Terms and Conditions. These remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

11.2. All copyrights, trademarks, and other intellectual property rights in the materials or content supplied as part of this website shall consistently remain vested in Alan Holloway.

11.3. The information presented on this website, as well as any linked websites, is intended for general interest only. While care has been taken in its preparation, we accept no responsibility for any misleading information or errors within this website or other websites referenced.

11.4. All photographs featured on this website are copyrighted by their respective owners. Any use of these photographs by third parties requires written permission from the copyright owners.

11.5. Unauthorized use of the contents on Alan Holloway's website and social media platforms is strictly prohibited without prior approval.

11.6. These Terms and Conditions will be governed by English law, and both parties agree to the exclusive jurisdiction of the English courts for any disputes that may arise between them.

11.7. These Terms and Conditions, in conjunction with Alan Holloway's current website prices, delivery details, and contact information, constitute the entire agreement governing the supply of products from Alan Holloway to you. Any statements made by salespersons on Alan Holloway's behalf should not be construed as variations to these Terms and Conditions or as authorized representations regarding the nature or quality of products offered for sale by Alan Holloway. With the exception of fraud or fraudulent misrepresentation, Alan Holloway shall not be liable for any misrepresentations being untrue or misleading.

11.8. Except for Alan Holloway's affiliates, directors, employees, or representatives, individuals who are not party to this agreement have no rights under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
